These Terms and Conditions govern the use of the website www.timmannaudio.com and the purchase of products and services from Timmann Audio. By accessing or using our website, or by placing an order, you agree to be bound by these Terms.
1. Definitions
1.1 Buyer / Customer Means any individual, company, or legal entity that places an Order on the website.
1.2 Seller Means Timar Vasile-Călin Întreprindere Individuală (hereinafter referred to as the 'Individual Enterprise' or 'We') headquartered at Blvd. Traian, Nr. 31, Ap. 10, Baia Mare, Maramureș County, Romania, registered with the Trade Register under No. F2026016137008, having Unique Registration Code 54345556; Special EU VAT Code RO54573198. The Seller is the manufacturer of Timmann Audio products and the owner/operator of www.timmannaudio.com.
1.3 User Means any person or entity who creates an account or browses the website.
1.4 Products and Services Means all microphones, accessories, and related services listed in the Order and supplied by the Seller to the Buyer.
1.5 Order Means the electronic document through which the Buyer communicates their intent to purchase Products from the Seller.
1.6 Contract The sales contract is concluded only upon issuance of the fiscal invoice by the Seller. Placing an Order or receiving an automatic order confirmation does not constitute contract conclusion. The Seller reserves the right to cancel any Order in case of errors (e.g., incorrect price, stock, specifications, or images) and will notify the Buyer accordingly.
1.7 Intellectual Property All content on www.timmannaudio.com — including images, graphics, text, logos, code, and design — is the exclusive property of Timar Vasile-Călin Individual Enterprise. Any unauthorized use is strictly prohibited and will be pursued according to applicable law.
1.8 Technical Specifications Means the technical details and descriptions of the Products as stated in the Order.
1.9 Acceptance of Terms By using, browsing, or purchasing from this website, you confirm that you have read, understood, and accepted these Terms and Conditions. The Seller reserves the right to update or modify the website and these Terms at any time without prior notice.
These Terms and Conditions apply to all sales of Timmann Audio products and services made through www.timmannaudio.com.
2. General Provisions
2.1 By using this website, you agree to these Terms and Conditions. 2.2 The Seller makes every effort to ensure the accuracy of information on the website but cannot be held responsible for occasional human or technical errors regarding prices, specifications, images, or product names. In such cases, the Seller reserves the right to cancel the affected Order(s). 2.3 The Seller reserves the right to modify the content of the website at its discretion without prior notice.
3. Products and Services
3.1 All Timmann Audio products manufactured by the Seller comply with CE standards. 3.2 The Seller is not responsible for incompatibility between Timmann Audio products and other equipment owned by the Buyer. For compatibility advice, please contact us via the Contact section. 3.3 The Seller assumes no liability for damage, injury, or malfunction resulting from improper use, handling, or operation of the products outside the conditions described in the User Manual provided with each product. 3.4 The Seller does not guarantee compatibility with the Buyer’s specific projects or requirements. 3.5 Images and technical specifications on the website are for illustrative purposes only. Delivered products may differ slightly in appearance, color, or accessories. 3.6 The Seller reserves the right to modify technical specifications without prior notice. 3.7 The Seller does not guarantee permanent stock availability. If a product is unavailable, the Seller may cancel or partially fulfill the Order and will refund any amounts paid (without additional compensation).
4. Warranty
4.1 Commercial Warranty – Timmann Audio The Seller offers a 36-month commercial warranty (starting from the date of purchase) for new Timmann Audio products purchased directly from www.timmannaudio.com or from authorized retailers. This warranty covers defects in materials, workmanship, or manufacturing under normal and intended use.
This commercial warranty is in addition to (and does not affect) your statutory legal rights under Romanian and EU law (including Emergency Government Ordinance 140/2021 and Government Ordinance 21/1992).
4.2 The warranty applies to all products listed in the Timmann Audio catalog on the website.
4.3 The warranty covers manufacturing defects in materials and workmanship under normal use.
4.4 Exclusions – Items not covered
- Cable clips
- Foam windshields for microphones
- Cases and housings
- Any consumable or wear-and-tear parts (subject to normal wear)
4.5 Exclusions – Situations not covered The warranty does not apply in the following cases:
- Minor aesthetic imperfections that do not affect functionality or value
- Damage caused by misuse, improper operation, incorrect voltage, or failure to follow the User Manual
- Damage resulting from unauthorized repairs or modifications
- Products with removed, altered, or damaged serial numbers or identification labels
- Exposure to liquids, chemicals, extreme temperatures, or humidity
- Defects caused by force majeure
- Defects the Buyer was aware of at the time of purchase
- Incompatibility with software or hardware not specified by the manufacturer
4.6 In case of a covered defect, the Seller will, at its discretion, repair or replace the product (or defective parts) free of charge. Replaced parts become the property of the Seller; replacement parts become the property of the Buyer.
4.7 Repairs or replacements under this warranty do not extend or restart the warranty period. Equivalent functional replacements may be used.
4.8 The Buyer is responsible for all shipping costs (to and from the Seller) for warranty claims. The Seller covers only the repair/replacement costs (materials and labor).
4.9 The maximum repair time is 15 calendar days from the date the product is received by the Seller.
4.10 Electronic tubes (valves) are considered consumables and carry a 24-month warranty.
5. How to Submit a Warranty Claim
5.1 To make a warranty claim, please contact us through the Contact section on www.timmannaudio.com. You may be required to register the product with your personal details.
5.2 You must provide the original invoice and proof of purchase. The serial number on the product must match the one on the invoice. Other documents (bank statements, PayPal confirmations, etc.) are not sufficient.
5.3 All warranty repairs must follow the process described in these Terms. The Seller will not reimburse repairs performed outside this process.
6. Limitation of Liability
6.1 The Seller’s liability under this warranty is limited to the repair or replacement of the defective product. The Seller is not liable for loss of data, financial losses, downtime, rental costs, travel costs, loss of profit, or any indirect or consequential damages. In any case, liability shall not exceed the purchase price of the product.
6.2 Other claims for damages based on the Timmann warranty are excluded, except where prohibited by mandatory law.
7. Return Policy (Right of Withdrawal)
7.1 According to Romanian Emergency Government Ordinance no. 34/2014, individual consumers (natural persons) have the right to withdraw from the contract within 14 calendar days from the date they take physical possession of the goods, without providing any reason and without incurring any costs other than return shipping costs.
7.2 To exercise the right of withdrawal, the Buyer must notify the Seller before the 14-day period expires by sending an email via the Contact section on the website.
7.3 If the Order has been paid, the Seller will refund the amount within a maximum of 14 days from the date the Buyer informs the Seller of the withdrawal. The refund will be made to the original payment method or to a bank account indicated by the Buyer.
7.4 The Seller may delay the refund until the products are received back and inspected, or until proof of shipment is provided.
7.5 Exceptions – No right of withdrawal applies to:
- Products made to order or personalized according to the Buyer’s specifications
- Consumables that have been unsealed and used
- Any other exceptions provided by law (Emergency Ordinance 34/2014, Article 16)
7.6 Returned products must be in their original packaging, with all accessories, labels, and documents intact, and accompanied by a copy of the invoice. Any missing accessories or damaged packaging may result in a reduced refund.
7.7 Returns are not accepted for products showing physical modifications, damage, scratches, dents, stains, or other signs of use beyond what is necessary to inspect the product.
7.8–7.12 The Buyer is responsible for any diminution in the value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the products. The Seller will notify the Buyer of any applicable deduction (typically between 5% and 90% of the original value, depending on the condition of the returned item).
8. User Obligations
Users agree to:
- Use the website only for lawful purposes
- Not upload, post, or transmit illegal, discriminatory, racist, threatening, obscene, defamatory, or otherwise objectionable content
- Respect all intellectual property, privacy, and other rights of third parties
- Not upload viruses, malware, or harmful scripts
- Provide accurate information when placing Orders (false information may lead to Order cancellation)
The Seller is not responsible for damages caused by user-generated content or comments. The Seller reserves the right to moderate or remove comments that violate these rules.
9. Pricing, Invoicing, and Payment
9.1 Prices and stock levels are updated regularly based on supplier costs and according to European regulations regarding the minimum annual ceiling up to which VAT is not paid (for individuals).
. 9.2 In case of obvious errors in pricing or product details, the Seller reserves the right to cancel the Order and will notify the Buyer. 9.3 The Seller is a non-VAT payer (Individual Enterprise). In case of exceeding the ceiling of 10,000 euros in annual sales to individuals in the EU (except for Romania where the ceiling is approximately 77,500 euros), the seller is obliged under Romanian legislation (article 315 of the Fiscal Code, Anaf Order no. 174/2026) and European legislation (EU directive 2017/2455, 2019/1995) to pay VAT, through the EU Special VAT Code RO54573198, which reaches the customer's country of residence. Prices displayed on the website are final, same for B2C and B2B and do not include shipping costs (unless free shipping is explicitly indicated for certain EU products).
9.4 Prices are shown in EUR. Romanian customers see prices in RON and pay in RON at the BNR exchange rate on the day of payment. 9.5–9.8 Accepted payment methods: credit/debit cards (Visa, Mastercard), PayPal, Google Pay, Apple Pay. All bank or payment processor fees are borne by the Buyer. The payment system is secured with 3D Secure. 9.9 For made-to-order or customized products, the Seller may require an advance payment. Full ownership transfers to the Buyer only after full payment is received.
10. Delivery
10.1 Delivery is made via Romanian Post or other courier services. 10.2 For in-stock products: delivery time is 2–20 working days from Order confirmation. 10.3 For custom or special-order products: delivery may take up to 60 working days. 10.4 Delivery times exclude public holidays and unforeseen events (weather, technical issues, etc.), which will be communicated to the Buyer as soon as possible. 10.5 Upon receipt, the Buyer should inspect the products for transport damage and verify that they match the Order. 10.6 Shipping costs are borne by the Buyer (except where free shipping is indicated). 10.7–10.9 Once the product is handed over to the carrier, all risks of loss, damage, or delay pass to the carrier. The Seller is not liable for issues occurring during transportation.
11. How to Place an Order
Orders are placed via the shopping cart and checkout process. An Order is not binding until confirmed by the Seller. The Seller may cancel an Order in cases such as payment rejection, incomplete data, stock issues, or suspected fraud.
12. Account Registration
Users may create an account using a valid email and password. The User is responsible for keeping login credentials secure. The Seller is not liable for unauthorized use of accounts.
13. Electronic Communication
All communications with the Seller are electronic. The Seller may send notifications regarding changes to these Terms by posting them on the website.
14. Force Majeure and Fortuitous Events
Neither party is liable for failure to perform obligations due to force majeure (fire, flood, earthquake, war, pandemic, etc.) or fortuitous events, provided the affected party notifies the other in writing within 5 days and provides supporting documentation. If the event lasts longer than 30 days, either party may terminate the contract with full refund of any advance payments for undelivered goods.
15. Dispute Resolution
Any disputes will first be resolved amicably. If no agreement is reached, the dispute will be settled by the competent courts at the Seller’s headquarters in Baia Mare, Romania.
16. Governing Law
These Terms are governed by the laws of Romania. By using the website, you agree to the exclusive jurisdiction of Romanian courts. Users accessing the site from outside Romania do so at their own risk and are responsible for compliance with local laws.
